When exceptions threaten to become the rule

Partner Fabiano Solano is a columnist for “Insolvência em Foco (Insolvency in Focus)”, of the Migalhas portal. In her first published article, she comments on the efficiency of the current insolvency law, but also on the threats that surround the system, such as the regime of exceptions of certain creditors to judicial reorganization, and the limitation of the competence of judicial reorganization judges in matters that are clearly under competition law. Among the points addressed, her article deals with the current situation of credits of commercial representatives and the guarantor who honors the credit after the filing for judicial reorganization.

Fabiana comments that these “are examples that militate against legal certainty and the efficiency of the system, to the detriment of the entire community of agents involved in this process: creditors, investors, the economy and debtors.”
