Dispute over Gol planes could go to court in the U.S.

Recently, the press highlighted the case of LatAm and Gol, in which LatAm tried to obtain Gol’s planes during its judicial recovery process. To discuss the subject, Valor Econômico invited our founding partner Thomas Felsberg.

 

According to Thomas, “They would be interfering in third-party rental contracts, between lessors and Gol. And the intent would be an attempt to take advantage of the insolvency process,” he said. But the lawyer considered that the dispute would not be so simple. “LatAm has a defense, because there is the possibility of rejection of contracts by Gol during the process [in which case, aircraft could go to another company, such as LatAm],” he said. Within Chapter 11, airlines have more flexibility in choosing which aircraft will remain in the fleet and which will not.
