Casas Bahia, Tok&Stok, InterCement: why out-of-court recoveries have soared in Brazil

Large companies are preferring extrajudicial recovery agreements. 2024 saw the largest volume of renegotiations carried out through this modality, already totaling a value of BRL 31 billion to date, more than 300% above the total for 2023. This format has been preferred, as it avoids the burdens of judicial recovery processes, which, in addition to being costly, also depend on the approval of a judge through the entire course and harm the company’s image.
