The scenario has been defined: the LGPD will come into force by 9/17/2020 and the National Authority for Data Protection (ANPD) has been structured

It has finally been decided, on 26 August 2020, that the General Data Protection Act (LGPD) will come into force in the coming weeks.

In an unexpected move, just one day after a decision by the House of Representatives to postpone the LGPD to December this year, the Federal Senate reversed this scenario by suppressing the device responsible for postponing the law – article 4 of Conversion Bill no. 34/2020, applied to Provisional Measure 959/2020. The Senate then issued a note to point out its understanding that the LGPD has not yet entered into force, as the President’s sanction or veto on the matter discussed in the Senate must be waited for, within the next fifteen business days. We will therefore know the exact effective date of the LGPD by 9/17/2020.
