STF decision reinforces contribution in the billions on one-third of salary for vacation

On 9 June, the Federal Supreme Court (STF) ruled that the votes of retired ministers may be considered valid in new trials. This decision opens a discussion in which companies might have to disburse around BRL 80 billion in social security contributions on the one-third salary due on employees’ vacation.

Partner Rodrigo Prado spoke to Folha de São Paulo about this matter and the importance of the STF modulating its decision, as a way of guaranteeing legal certainty, since the STF’s understanding that the social security contribution is levied on the vacation third contradicts the established jurisprudence that existed on the issue.
