Last week, the STF began its finding on the confiscatory and disproportionate nature of the isolated fine imposed due to non-compliance with an ancillary obligation.
The case deals with a fine, imposed by the State of Rondônia, of 40% on the value of the operation, resulting in a penalty that would be higher than the amount of tax collected.
