The recent decision by the STJ regarding the exclusion of cooperative credits from judicial recovery has sparked significant debates within the legal and business communities, and our partner Fabiana Solano was one of the invited experts to comment on the topic in an article published by The AgriBiz.
With extensive knowledge in restructuring within the agribusiness sector, Fabiana analyzes the practical effects of the decision, which further complicates the restructuring paths for producers and companies in difficulty, and encourages the negotiation of bilateral agreements. “In practice, the view is that the RJ law is being systematically undermined. In this scenario, creditors not subject to the recovery plan end up signing individual agreements with the debtor because they recognize that payment of their credits does not fit into the company’s cash flow.”
