In a decision issued on 14 April (ARE 1532603 RG/PR), Minister Gilmar Mendes ordered the suspension of all processes in the country that discuss the allegation of fraud in the outsourcing of services through the hiring of legal entities (pejotização), until the final judgment of the issue by the Supreme Federal Court (STF).
According to the Minister, there is a ‘repeated refusal of the Labor Court to apply the guidance of the STF’, which has been generating legal uncertainty and an increasing number of actions that end up overloading the Supreme Court.
The decision recognizes that the controversy has directly affected the freedom of productive organization and the stability of the legal system, making urgent a definitive position from the STF on the subject.
