Isolated fine on non-approved compensation and reimbursement claims deemed unconstitutional by the STF

Anna Flávia de Azevedo Izelli Greco, Rodrigo Prado Gonçalves and Fernanda Abasolo Lamarco comment in a new Tax Alert on the decision of the Federal Superior Court (STF) that judged unconstitutional the isolated fine on non-approved compensation and reimbursement requests.

 

The understanding adopted by the Supreme Court has immediate repercussions on ongoing administrative proceedings and brings up the possibility of a taxpayer requesting compensation and reimbursement of amounts unduly paid as a separate fine in the last five years.
