At the end of last month (February 2023), Resolution CD/ANPD No. 4 was published, which approved the ANPD Regulation of Dosimetry and Application of Administrative Sanctions (“Regulation”). The publication represents, in practice, the concrete possibility of application by the ANPD of administrative sanctions, provided for in article 52 of the LGPD, to organizations that fail to comply with the aforementioned law or the regulations of the Authority, since it establishes the long-awaited parameters and criteria for such sanctions, and defines forms and dosimetry for calculating the base value of fines.
