Activities considered essential, which involve the health, industrials, commerce, transport, energy and funeral sectors, among others, will have to function on the 7 September holiday. According to the CLT, working on Sundays and holidays guarantees the worker 100% overtime.
Maurício Pepe De Lion, a partner in our Labor department, commented on the matter to Folha de São Paulo and stressed that the best action is to talk. “Trying to negotiate is the best way. If there is any disagreement with respect to just one day, a labor action should not be proposed”, he says.
