Annual Census of Foreign Capital in Brazil 2022 – Base Year 2021

The Central Bank of Brazil is conducting the Annual Census of Foreign Capital in Brazil 2022, regarding the base year of 2021, pursuant to the Circular No. 3,795, of June 16, 2016, issued by the Central Bank of Brazil, and published in the Brazilian Federal Gazette on June 17, 2016, which consolidated the regulations for the Annual and the Quinquennial Censuses of Foreign Capital in Brazil.

This measure is intended to compile statistics on the external sector, in particular the International Investment Position, thereby supporting the formulation of economic policy, and assisting the activities of economic researchers and international organizations.

In view of the foregoing, from July 1st to August 15, 2022, at 6:00 p.m., the data for the Annual Census must be submitted to the Central Bank of Brazil by:

a) Legal entities headquartered in Brazil that, on December 31, 2021, held in the composition of their capital stock direct participation of non-resident investors in any amount, and whose net worth was equal to or higher than the equivalent in Brazilian Reais to USD 100 million (one hundred million US dollars);

b) Investment funds with non-resident investors and net worth, on December 31, 2021, equal to or higher than the equivalent in Brazilian Reais to USD 100 million (one hundred million US dollars), through their managers; and

c) Legal entities headquartered in Brazil that, on December 31, 2021, were debtors of foreign short-term commercial credits (payable up to 360 days) granted by non-resident investors in an amount equal to or higher than the equivalent in Brazilian Reais to USD 10 million (ten million US dollars).

The following persons are exempted from the aforementioned obligation: individuals; federal, state or municipal government bodies; legal entities that are debtors of on-lending foreign credits granted by institutions based in Brazil; and non-profit entities maintained through contributions from non-residents.

Failure to submit the data for the Annual Census, their untimely submission, or their submission in breach of the conditions provided for in the regulations in force regarding Foreign Capital in Brazil, or, even, the submission of false, incomplete, or incorrect information, may subject the legal entities and the investment funds referred to above to the pecuniary penalties set forth in the Resolution No. 131, of August 20, 2021, of the Central Bank of Brazil.
