STF reduces ICMS rate on electricity and telecommunications services

In a recent decision, the STF considered the law of the state of Santa Catarina, which provides for ICMS at the rate of 25% on electricity and telecommunications services, to be unconstitutional.

Anna Flávia Izelli Greco and Rodrigo Prado Gonçalves, partners in Felsberg Advogados’ tax litigation area, have produced an Alert commenting on this recent STF decision, as well as commenting on the possibility of taxpayers from other states of the Federation questioning not only the ICMS rates on electricity and telecommunications services, but also on other products considered essential.
