New Trade Remedy Investigations in Brazil

The Department of Trade Remedies (DECOM) of the Ministry of Development, Industry and Foreign Trade recently launched several new anti-dumping investigations and a safeguard investigation in Brazil. These initiatives include:

(i) Anti-dumping investigation into imports of AISI 304 and AISI 316 stainless steel welded tubing (NCM 7306.40.00 and 7306.90.20) from China and Taiwan. This investigation was initiated by SECEX Circular Nº. 6 on March 7, 2012, at the request of the Brazilian manufacturer Aperam Inox Tubos do Brasil Ltda.

(ii) Anti-dumping investigation into imports of AISI 304 and AISI 430 stainless steel flat products (NCM 7219.32.00, 7219.33.00, 7219.34.00, 7219.35.00 and 7220.20.90) from South Africa, Germany, China, South Korea, United States, Finland, Taiwan and Vietnam. This investigation was initiated by SECEX Circular Nº 17 on April 13, 2012, at the request of the Brazilian manufacturer Aperam Inox América do Sul S.A.

(iii) Anti-dumping investigation into imports of flat-rolled products of silicon-electrical steel (NCM 7225.19.00 and 7226.19.00) from South Korea, China and Taiwan. This investigation was initiated by SECEX Circular Nº 18 on April 19, 2012, at the request of the Brazilian manufacturer Aperam Inox América do Sul S.A.

(iv) Anti-dumping investigation into imports of hot-rolled flat low-carbon steel products (NCM 7208.51.00 and 7208.52.00) from South Africa, Australia, South Korea, China, Russia and Ukraine. This investigation was initiated by SECEX Circular Nº 19 on May 3, 2012, at the request of the Brazilian manufacturer Usiminas S/A.

(v) Anti-dumping investigation into imports of mono-ethanolamine and tri-ethanolamine (NCM 2922.11.00 and 2922.13.10) from the United States and Germany. This investigation was initiated by SECEX Circular Nº 20 on May 10, 2012, at the request of the Brazilian manufacturer Oxiteno Nordeste S.A. Indústria e Comércio.

(vi) Safeguard investigation into imports of wine (NCM 2204.21.00). This investigation was initiated by SECEX Circular Nº 9 on March 15, 2012, at the request of several Brazilian winemaking trade associations. This investigation may result in the application of a safeguard measure affecting all wine exporters, except those based in Uruguay, Paraguay and Argentina, which are MERCOSUR Member States.

Safeguard and antidumping investigations are carried out by DECOM and the involvement of exporters and importers in these proceedings is highly recommended. Their participation can result in the reduction of the duty to be applied by the authorities or in the termination of the investigation without the application of any duty.
