Trade Remedies – New Antidumping Investigations and Revisions

In the last two months, the Department of Trade Remedies (DECOM) of the Ministry of Development, Industry and Foreign Trade has initiated the following anti-dumping investigations, as well as four sunset reviews:

(i)     Anti-dumping investigation on importation of seamless carbon steel pipes (NCM 7304.19.00) from China. This investigation was requested by Vallourec & Manesmann Tubes – V&M do Brasil S/A and was initiated by SECEX Circular nº 26 published on June 21,2012.

(ii)    Anti-dumping investigation on importation of new tires for motorcycles (NCM 4011.40.00) from China, Thailand, Taiwan and Vietnam. This investigation was requested by ANIP – National Association of Pneumatic Industry and was initiated by SECEX Circular nº 27 published on June 25, 2012.

(iii)   Anti-dumping investigation on importation of basic refractories (NCM 6902.10.18 and 6902.10.19) from China, United States and Mexico. This investigation was requested by ABRAFAR – Brazilian Association of Refractory Producers and was initiated by SECEX Circular nº 30 published on July 2, 2012.

(iv)   Anti-dumping investigation on importation of nylon yarn (NCM 5402.31.11, 5402.31.19 and 5402.45.20) from China, South Korea, Thailand and Taiwan. This investigation was requested by Rhodia Poliamidas e Especialidades Ltda. and was initiated by SECEX Circular nº 32 published on July 9, 2012.

(v)    Anti-dumping investigation on importation of new tires for passenger vehicles of 65 and 70 series, with 13” and 14” rims (NCM 4011.10.00) from South Korea, Thailand, Taiwan and Ukraine. This investigation was requested by ANIP – National Association of Pneumatic Industry and was initiated by SECEX Circular nº 34 published on July 19, 2012.

(vi)   Sunset review of the anti-dumping duties applied to importation of electric irons (NCM 8516.40.00) from China. This review was initiated by SECEX Circular nº 29 published on June 25, 2012.

(vii)  Sunset review of the anti-dumping duties applied to importation of electric table fans (NCM 8414.51.10) from China. This review was initiated by SECEX Circular nº 37 on August 6, 2012.

(viii) Sunset review of the anti-dumping duties applied to importation of pulley tackles and hoists (NCM 8425.19.10) from China. This review was initiated by SECEX Circular nº 38 on August 21, 2012.

(ix)   Sunset review of the anti-dumping duties applied to importation of new tires for passenger vehicles of 65 and 70 series, with 13” and 14” rims (NCM 4011.10.00) from China. This review was initiated by Secex Circular nº 39 on August 23,2012.

The anti-dumping investigations and the sunset reviews are carried out by DECOM and last approximately twelve months. The anti-dumping investigations may or may not result in the application of a dumping duty to the investigated import. If a dumping duty is applied, it will remain in force for five years. The sunset reviews may result in the maintenance of the duty at the same rate or at a different rate, or may result in the suspension of the antidumping duty. The involvement of exporters and importers in these proceedings is highly recommended and may influence the final results.
