New cooperation agreement expedites merger review
On August 19, 2007, SDE (Secretariat of Economic Law) and CADE (Administrative Council for Economic Defense) through its Attorney-General executed a cooperation agreement aimed at reducing even further the time for review of transactions with minimum or no anticompetitive impact.
SDE will cease its analysis of formal issues (e.g. timeliness and filing of the necessary documents), which will be reviewed exclusively by the CADE Attorney General.
Felsberg e Associados believes that this measure will reduce the review time by up to 5 days. Thus, transactions that do not raise any antitrust concerns may be approved by CADE within 1 month.
